What are the chances of getting a pre-trial diversion with misdemeanor theft charge in Santa Clara County?

It was my first time, and yes. An obvious error. I do anything to be able to not have this charge on my album, I'm willing to pay all fines and do community service ... I'll be getting a lawyer, but I just wanted to know how the referral of a program of pretrial diversion is happening and if it is even likely I'll be by. I think I'll plead not guilty at arraignment and go for some kind of plea bargain ... but I just want to know my options. It was a mistake I know I will pay I just want to do my best to not let it affect my future as much as I can. Also, I heard that Santa Clara County does not even have a pre-diversion program the trial ... Is this true? And would it be possible to apply anywhere else?

This is something to discuss with your attorney, however, if the county does not provide in itself pretrial diversion, you can request a change of venue on the basis of wanting to erase his history of probation upon completion. A change of venue only allowed when a person can not receive a fair trial, based on negative publicity or too high a profile for the county to go to court. Your best option is an expungement one year after completing their probation. Again, talk to your lawyer before the trial and can be configured for you. Good luck and I hope this is helpful
